Dealing with Third Party Information

As you may be aware the Freedom of Information Act 2000 (the ‘Act’) came in to effect on January 1 2005. This Act allows anyone the right to ask for information held by Ofcom.

We sometimes receive requests to disclose information provided to Ofcom by a third party.

It is not our intention to release third-party information that has been obtained under a statutory power, may be regarded as 'confidential' or that is particularly commercially sensitive, as these areas are potentially covered by exemptions under the Act. However, the Act does not allow the use of these exemptions in an arbitrary fashion to avoid complying with an information request.

Therefore, in order to meet these information requests, it may be necessary from time to time to contact the owner of the information in order to discuss with them the nature of the information we hold and whether we could disclose that information; before deciding whether to disclose the existence or content of that information.
