Amended Annex 9
Introduction
1.1 On 17 November, 2006 Ofcom published its Statement and Further Consultation on the Television Advertising of Food and Drink Products to Children, including Annex 9: Television Advertisements – rules on scheduling and advertising practices. Annex 9(A) set out the advertising scheduling rules proposed for putting into effect Ofcom’s preferred package of restrictions, namely a Modified Package 1, which amends Package 1 through extending the restriction on HFSS advertising in or adjacent to programmes of particular appeal to children aged 4-15 (from 4-9). For completeness, the Annex also included, at Annex 9(B), the revised advertising content rules previously consulted on.
1.2 Following publication some minor textual errors were noted in the Annex. The re-issued Annex published today replaces that published on 17 November 2006. Accordingly, in responding to the current consultation, consultees should therefore have regard to this version rather than that previously published.
1.3 For the avoidance of doubt, we are also taking this opportunity to draw to consultees' attention that Ofcom is currently consulting on the proposed wording of the scheduling rules set out in Annex 9(A) of the Statement and Further Consultation. These rules would apply were a decision made to adopt modified Package 1 ie if Ofcom were to decide that new restrictions should prevent advertisements for HFSS products being advertised in or adjacent to children's programmes or programmes commissioned for, principally directed at or likely to appeal particularly to audiences below the age of 16.
1.4 The current consultation seeks views only on the proposed scheduling rules in Annex 9(A). The draft content rules in Annex 9(B) formed part of the earlier consultation (Television advertising of food and drink products to children - Options for new restrictions) issued in March 2006. They are therefore not part of the current consultation.
1.5 In response to stakeholder request, the consultation period has also been extended until 28 December 2006.
