Can I find out about trades which are in progress?

Will information about the transfer be publicly available?

Yes. Once a transfer application is being progressed by Ofcom, Ofcom will update the Trade Notification Register ( TNR ) to reflect this along with details of the trade. The TNR will then indicate that the transfer has been given consent by Ofcom and ultimately completed with the completion date. If the trade was not completed the TNR will be updated to reflect this however, no information will be give on the TNR as to why not (i.e. it will not say whether the trade was not completed because consent was not given by Ofcom, or because the parties concerned withdrew their request). We will also update the WT Act Register (WTR) to ensure that any new licence holdings are reflected.

Regulation 8(6) of the Spectrum Trading Regulations requires Ofcom to publish information about the effected transfer.

Can third parties provide input into Ofcom’s approval process?

Ofcom will not formally consult before giving or refusing consent to any proposed trades, but will take into account relevant information supplied by third parties in reaching our decision. Third parties can learn about proposed trades via the online Trade Notification Register ( TNR ) (see section 5) and may make representations concerning a particular trade by writing to the Spectrum Trading Desk (see section 8 for contact details).
