1. The ITC has decided to take measures to control practices by Licensees in the field of channel bundling and in particular has decided to prohibit the imposition of minimum carriage requirements. Details of the relevant measures and of the dates on which they take effect are contained in the lTC's News Release dated 26 June 1998 ("ITC Confirms End of Minimum Carriage Requirements"). Licensees will have received a Direction, pursuant to the terms of their respective licences, giving effect to the ITC's decision.
2. It is for each Licensee to ensure that they comply with the ITC's Direction to them, but in response to requests made during the consultation prior to the ITC's decision, the ITC considers that some additional guidance on the measures covered by the Direction would be helpful. This Guidance accordingly describes in more detail than would be appropriate in a licence direction the scope of the ITC’s measures and the practices they are intended to cover. While this Guidance is intended to help Licensees ascertain which arrangements or possible arrangements would be prohibited by the Direction, it cannot be taken to limit the lTC's discretion in assessing the facts and circumstances of any particular situation and deciding whether in any particular case a breach of the relevant licence has occurred. This Guidance will be kept under review by the ITC and may be modified in the light of change in any circumstances and the lTC's experience.
