Background
This trailer was for an upcoming new series featuring young, irreverent magicians performing unorthodox magic tricks, some of them on unsuspecting members of the public and celebrities.
Issue
The trailer was broadcast during the children's morning zone, Milkshake. One viewer complained that a magician appearing to regurgitate a mouse in front of a startled tv presenter was unacceptable and had upset her young child.
Assessment
Five said that the trailer was not cleared to be shown around children’s programmes, but that the restriction was initially overlooked and it was transmitted accidentally. The mistake was spotted almost immediately and swiftly rectified. The ITC noted the channel's recognition that an error had occurred and the quick action taken to rectify the problem.
Conclusion
The trailer was in breach of Section 1.4(iii) which requires that all trailers and promotions shown before the watershed must comply with Family Viewing policy and be scheduled with special care.
