The working
group on broadband migration will be responsible for reviewing the
legal, contractual and commercial issues associated with the migration
of broadband services from one service provider to another.
The specific
points to be addressed are:
1. What form
of consent is required from a losing service provider under current
contractual arrangements, and should this be changed?
2. What constitutes
legitimate save activity by a losing service provider, and what
does not? Are there specific issues that arise when the losing service
provider is BT (eg use of information)?
3. What consumer
protection measures need to be in place to protect against slamming?
4. In relation
to such migrations, what other issues raise concerns? Document a
more comprehensive issues list, and identify the appropriate way
to take the issues forward.
The scope of
this work should not just include migrations of the same wholesale
product between service providers, but also include migrations between
service providers using different wholesale services. However, the
specific technical and process issues associated with migrations
between different wholesale services fall outside the scope of this
working group and will be dealt with as separate work packages.
