Notice under
Sectio 12(2) of the Telecommunications Act 1984 ( As amended by
The Electronic Communications Act 2000)
1. The Director
GenNoticeseral of Telecommunications (the "Director"),
hereby gives notice, in accordance with section 12(2) of the Telecommunications
Act 1984 as amended by the Electronic Communications Act 2000 (the
"Act"), that he proposes to make a modification to the
licence (the "Licence") originally granted by the Secretary
of State for Trade and Industry to HSCO Limited under Section 7
of the Act on 23 January 1997 under which Crown Castle UK ("CCUK")
now provides, inter alia, certain analogue transmission services
to the BBC.
2. The Director
proposes to modify the definition of "Relevant Price"
currently set out in Condition 9.9 of the Licence. The effect of
the modifications which the Director proposes to make is set out
in the Schedule below.
3. The reason
for the modification is to ensure that CCUK is able to meet the
BBC’s requirements for additional services in accordance with the
price control provision in the licence.
4. The consultation
period comprises two stages. In the first stage, representations
on or objections to the proposed modifications may be made to Robert
MacDougall, Oftel, 50 Ludgate Hill, London EC4M 7JJ (telephone 020

robert.macdougall@oftel.gov.uk) by no later than 8 June 2001. Objections
to the proposed modification should be accompanied by a notice stating
clearly that it is an objection to the modification.
5 Any confidential
material should be clearly marked as such and separated out into
a confidential annex. All representations and objections received
by Oftel, with the exception of material marked confidential, will
be made available for inspection in Oftel’s Research & Intelligence
Unit and may be published.
6 In the
second stage of consultation, interested parties are invited to
send comments on representations and objections received in the
first stage to Robert MacDougall at Oftel, details as above, by
no later than 22 June 2001. Copies of the proposed modification
can be obtained from Robert MacDougall at the above address.
THE SCHEDULE
1 The
effect of the modification is to alter the definition of Relevant
Price as currently set out in Condition 9.9 of the Licence.
This will clarify that Relevant Price services are those services
which are of the same nature and extent as those charged for
and provided to the BBC between 1 April 1996 and 31 March 1997.
