It was alleged that Inclarity was misusing the 070 personal number range, contrary to the Numbering Conventions, which state that 070 numbers should only be used for "find-me-anywhere" services. In particular, it was alleged that evidence of overlapping call patterns demonstrated that Inclarity's use of 070 numbers was in breach of the Numbering Conventions.

Oftel was concerned that overlapping calls to 070 numbers could indicate that the number was being used for a general contact number (eg for an information service, entertainment service or contact centre) rather than as a 'find-me anywhere' personal number. A characteristic of a general contact number is that it can support multiple calls and Oftel's investigation focussed on this potential use.

Inclarity has provided details of the service it is providing on 070 numbers. They offer a personal numbering service for users in Kurdistan who wish to be contacted there. In certain parts of Kurdistan, calls must be routed via a call centre which manually connects calls, as the supporting infrastructure to enable all calls to be routed automatically is not available. As a result, it is possible for one call to be routed through to the customer, but with subsequent, overlapping calls to be answered by the call centre but without final connection to the customer. This scenario is entirely consistent with the evidence provided of one call being connected for some time and others of much shorter duration to the same number appearing as overlapping calls.

In addition, Oftel understands that the service operates strictly as a personal number service in the same way as a fully automated service. The end user controls where the call is routed to and there is no end-user revenue sharing. Therefore, Oftel concludes that there is no breach of the Numbering Conventions and has closed the investigation.
