Issue: Alleged use of automatic calling equipment to make
calls without the consent of the called parties
Relevant instrument: Condition 5 of the Class Licence for the
running of Self Provided telecommunications systems
It has been
alleged that Komtel Ltd use automatic calling equipment to make
very short duration calls to consumers, leaving an 070 number
as the calling line identity. Consumers who ring back the number
are allegedly then kept on the line for long durations of time
at charge rates of up to 37.5p per minute.
Automatic
calling equipment may only be used to make calls where the called
party has expressly consented to receive such calls. Oftel is
currently investigating to see whether automatic calling equipment
has been used and, if so, whether consent was provided by the
called parties.

Note - 26 June 2003
As Komtel
operates under the International Simple Voice Reseller (ISVR)
class licence, Oftel has taken this investigation forward under
Condition 9 of the ISVR rather than Condition 5 of the Class licence
for the running of Self Provided telecommunications systems referred
to in the original Competition Bulletin opening entry.
Oftel has
concluded that Komtel was using automatic calling equipment to
make short duration calls to consumers, without first obtaining
their consent. Oftel has, therefore, given notice of its proposal
to issue a final order against Komtel for breach of Condition
