Telewest complained that Corporate Communications had refused to port a non-geographic number, which was being used by another company as its helpline number.

On 21 August 2003 Corporate Communications informed Oftel that it had reached agreement with the company using the number in question to port that number to Telewest.

Telewest withdrew its complaint on 4 September 2003 following successful porting of the number on 1 September 2003. Oftel has therefore closed the case.

Condition 23 of the Telecommunications Services Licence (the "TSL Licence")

Telewest has complained about Corporate Communications’ (CC) refusal to port a non-geographic number, which is currently being used by another company as its helpline number.

CC argues that it is not under an obligation to port the number. It maintains that it is the subscriber of the number in question and, as such, has the right to exclusively control the use of the number. It denies that it is a reseller of the number or a licensed operator with Number Portability obligations.

The Director has opened an investigation to establish whether CC has an obligation to port the number in question.

The investigation will look at the exact service that is being provided by CC using the number in question and reach a view regarding:

CC’s status as a provider of Publicly Available Telephone Services (PATS) to the company using the number as its helpline number and the status of that company as a Subscriber for PATS from CC.; and
Whether CC is regulated by the TSL Licence or under the Number Portability Regulations as a Systemless Service Provider.
