Complaint from FDM Technologies against BT about delayed provision of broadband services

Complainant: FDM Technologies
Complaint against: BT
Case opened: 17 September 2003
Issue: Delayed provision of broadband services
Relevant instrument: Chapter II of the Competition Act 1998 (abuse of a
dominant position)

The complainant is a wireless broadband ISP who ordered leased lines from BT to establish a broadband wireless service in 3 areas in East Wiltshire and Berkshire. The complainant has experienced a number of delays and difficulties with its orders. It alleges that BT has behaved in an anti-competitive manner by delaying the provision of the leased lines, to give BT time to roll out its own DSL products in those areas before the complainant can begin supply of its service.

Oftel is currently considering the allegations.
