Corrections to the Oftel Statement entitled Proposals for Network Charge and Retail Price Controls from 2001, February 2001 Layout image

1  On 1 February 2001, Oftel published a Statement entitled Proposals for Network Charge and Retail Price Controls from 2001, which is publicly available both on Oftel’s web site and from Oftel’s Research and Intelligence Unit in a printed paper format. It has now come to Oftel’s attention that certain parts of Annexes F and G to this Statement contain some accidental errors in the printed version of the Statement as well as that of the version posted on the Internet.

2  As to the printed version of the Statement, it should be noted that the formula set out in Condition 69.8 of BT’s licence has been incorrectly presented at Annex F and, as Oftel has not proposed to modify it, it should instead read as set out under paragraph 12 of Schedule 2 to the Telecommunications (Licence Modification) (British Telecommunications plc) Regulations 1999, Statutory Instrument 1999 No. 2453.

3  Condition 66.45 of Concert’s licence sets out the same formula and it has also been incorrectly presented at Annex G to the Statement in the printed version. As Oftel simply proposes to delete the entirety of Condition 66.45, it should instead read as set out in the Schedule to the Instrument of Modification dated 22 December 1999 by the Director General of Telecommunications concerning certain modifications to the licence granted to Concert Communications Company, albeit the Condition should now be marked as deleted.

4  The same above-mentioned formula has been incorrectly presented in both Annexes F and G of the Internet version of the Statement. It is therefore to be noted that this formula should read as explained in paragraphs 2 and 3 of this notice above for purposes of BT’s licence and Concert’s licence, respectively.

5  In addition, the Internet version of the Statement only has incorrectly presented the following matters and they should therefore read as set out in the printed version of the Statement, as further explained below:

  • In Condition 69.4(i), at Annex F, the words "conditions for the proposed New Standard Service;" should follow immediately after the words "and associated terms and";
  • In Condition 69.22, at Annex F, in the sub-paragraph immediately after paragraph (d) the entire text immediately after the words "does not increase" has been struck through from the words "in the first Relevant Year" to the words "For the purposes of compliance with this paragraph:". The text that should have been struck through begins with the words "in the first Relevant Year" and ends with the words "has been applied by more than RPI and". The proposed new sub-paragraph would therefore, when proposed deletions have been removed, read as follows:

"does not increase during any following Relevant Year by more than RPI (taking out of account, where applicable, any payment by the Licensee to a person operating a telecommunication system outside the United Kingdom. For the purposes of compliance with this paragraph:";

  • In Condition 72.5, at Annex F, the defined terms under this Condition starting with "Average Net Retention" and ending with "Year" should be in a vertical line, except for the paragraphs (a) to (d) that follow the defined term "Call" as these paragraphs should be indented; and
  • Elsewhere in Annexes F and G some text is presented in bold or in a different font to those presented in the printed version of the proposed modifications. Where there are differences between the Internet and the printed versions of the proposed modifications, the printed version is correct.

6  For the avoidance of any doubt, it should be noted that Oftel is formally consulting on matters and proposed modifications as set out in the printed version of the Statement, as corrected by this notice.
