Draft Agreement

Agreement between US and AN Other on the deployment of Point-to-Multipoint Equipment in the same 28GHz frequency bands in different but neighbouring French regions.

We hereby mutually agree to:

  1. Not to transmit on any channel from a radio base station or a customer station channels in frequencies (<27669 MHz – 27697 MHz>) such that that the spectral power flux density exceeds
    –110dBW / MHz * m2 at a distance of 15km outside OUR licensed region.
  2. Not to transmit on any channel from a radio base station or a customer station channels in frequencies (<25697 MHz – 25753 MHz>) such that that the spectral power flux density exceeds
    –110dBW / MHz * m2 at the boundary of OUR licensed region.
  3. Not to transmit on any channel from a radio base station or a customer station channels in frequencies (<25753 MHz – 25781 MHz>) such that that the spectral power flux density exceeds
    –110dBW / MHz * m2 at the boundary of OUR licensed region or to deploy any equipment within 15km of the region boundary that either transmits on the frequency or receives (on its paired duplex frequency).
  4. Without prior agreement, transmit on any channel an Effective Isotropic Radiated Power (EIRP) of greater than [50] dBm within 15km from the mutual license region boundary.
  5. Within [6] months of deployment in a particular region inform the other of the type of any equipment that will be deployed in the adjacent region. This information will include:
    Standards complied to
  6. Channel Bandwidth (effective and 3 dB)

    Channnel Power (Effective Isotropic Radiated Power)

    OOB emissions

    Maximum acceptable interference power

    Any other parameters pertinent to interference protection

  7. Within [3] months of deployment in a particular town within 15km of the region boundary inform the other of the location of any sector of a BS that is planned. The information provided will include:

    Height of Sector

    Azimuth of Sector

    Transmit Frequency of sector

    3dB Beamwidth of Sector

    Maximum EIRP of Channel

  9. Without prior agreement, deploy equipment in an adjacent region within 15km of the shared boundary that does not comply with one of the following ETSI standards:

    EN 301 213-1

    EN 301 213-2
    EN 301 213-3

  11. In the event of that an operational problem is identified in the operational network that is caused by interference from the other operator the instigate the following procedure:

(i) The interfering operator should be informed in writing of the problem. Such information that is required to define and identify the cause and impact of the problem should also be provided.

(ii) Within [3] weeks of receipt of this information the interfering operator should arrange a meeting with suitably qualified personnel from each operator to discuss potential solutions and agree an action plan to resolve the problem.

(iii) If no agreed action plan then the matter will be referred to an independent arbitrator who will decide on a course of action (RA? is this really possible??)
