Complaint from BT against PNC about number portability

BT claimed that PNC was failing to meet its regulatory obligations to provide portability on reasonable terms particularly in relation to timescales. BT therefore asked the Director to investigate this matter and require PNC to provide:

(i) a date by which PNC would resolve all outstanding engineering testing issues;
(ii) a date by which BT could resume engineering testing;
(iii) a date by which BT could begin operational readiness testing, and;
(iv) a date by which numbers could be imported to BT.


On 4 December 2003, PNC provided a written undertaking requested by the Director to:

(i) resolve all engineering testing issues originally raised by BT by 16 January 2004;
(ii) resume the engineering testing stage in the service establishment process by 19 January 2004;
(iii) the successful completion of the operational readiness testing by 23 January 2004, and;
(iv) the completion of the porting of the numbers to BT free of technical faults by 1 February 2004.


In the light of the undertaking given by PNC, the Director has decided to close the case. However, the Director expects PNC to comply with the timescales submitted and reserves the right to re-open this investigation should he not be satisfied that PNC is using its best endeavours to provide portability to BT as soon as reasonably practicable.
