Case opened: 1 February 2005
Case Closed: 27 May 2005
Issue: Alleged unfair contract terms
Relevant instrument: Unfair Terms in Consumer Contracts Regulations 1999

Ofcom received a complaint about the terms and conditions in DeeNine's Hostplus Internet hosting contract (the "Contract"). Ofcom analysed the terms and conditions contained in the Contract and concluded that certain of those terms and conditions were potentially unfair.

During the course of the investigation, DeeNine's hosting accounts were taken over by Andhosting LLC. Andhosting LLC has undertaken not to enforce or rely upon the terms and conditions contained in the Contract that Ofcom considered to be potentially unfair.

Ofcom has therefore closed this investigation.
