Complaint from Islington Council Trading Standards against Internet Telecommunications Plc about unfair contract terms

07 July 2005

Complainant: Islington Council Trading Standards
Complaint against: Internet Telecommunications Plc
Case opened: 8 March 2005
Case closed: 6 July 2005
Issue: Alleged unfair contract terms
Relevant instrument: Unfair Terms in Consumer Contracts Regulations 1999 (“the Regulations”).

Ofcom received a complaint about terms in Internet Telecommunications Plc's ("IT") terms and conditions. Ofcom analysed IT's terms and conditions and concluded that certain of the terms and conditions were potentially unfair under the Regulations.

During the course of the investigation IT advised Ofcom that it will be introducing new terms and conditions from 1 August 2005 which it believes will address Ofcom's concerns. IT has undertaken not to enforce or rely upon the current terms and conditions that Ofcom considered to be potentially unfair in the interim period. Ofcom has accordingly closed this case.

It should be noted that Ofcom has not analysed the new terms and conditions to be introduced by IT. Ofcom will monitor the introduction of the new terms and conditions.
