Complainant: Europacom.net
Complaint against: MCI
Case opened: 27 September 2005
Case closed: 23 January 2006
Issue: Number Portability
Relevant instrument: General Condition 18 of the General Conditions of Entitlement, which governs number portability

During the course of this investigation, Europacom's chosen new provider resubmitted porting requests to MCI. Europacom has since confirmed to Ofcom that the numbers have been ported and that as a result there are no outstanding freephone numbers to port from MCI to their new chosen Communications Provider.
Given that porting has now taken place, Ofcom has closed this investigation.

Europacom.net complaint against MCI in connection with requests for the porting of numbers

Complainant: Europacom.net
Complaint against: MCI
Case opened: 27 September 2005
Issue: Number Portability
Relevant instrument: General Condition 18 of the General Conditions of Entitlement, which governs number portability

Ofcom has received a complaint from Europacom.net which has requested that MCI port freephone non-geographic numbers to its new chosen provider. Europacom.net claims that these porting requests have been subject to delay and refusal by MCI.

All Communications Providers are required by General Condition 18 to provide number portability as soon as it is reasonably practicable and on reasonable terms to any of their subscribers who so request. Communications Providers must, following a request from another Communications Provider, provide portability as soon as is reasonably practicable in relation to that request, on reasonable terms and in accordance with the Number Portability Functional Specification.

Ofcom is considering Europacom's complaint.
