Following Ofcom's revised guidance on the use of the 070 number range, which it published on 24 January 2004, Ofcom has considered whether Inclarity's use of 070 numbers to provide telephony services to northern Iraq is in accordance with Condition 17 of the General Conditions of Entitlement.

Ofcom was concerned that the service offered by Inclarity was not in accordance with appropriate use of 070 numbers as set out in the revised guidance, notably paragraph 14 of the revised guidance which states that:

"The End-User cannot be in charge of their number if that number can also be used to contact, e.g. through a switchboard, another End-User".

Inclarity has already made some changes to the way its service works, and intends to make further changes which Ofcom considers will ensure that Inclarity's use of 070 numbers is consistent with the revised guidance and complies with General Condition 17. Ofcom has therefore decided to close its investigation but Ofcom will monitor Inclarity's progress in implementing these changes.

In the light of Ofcom's revised guidance on the use of the 070 number range, which was published on 24 January 2004 (see Related Items), Ofcom has opened an investigation to consider whether Inclarity's use of 070 numbers to provide telephony services to Northern Iraq, via call centres, is in accordance with Condition 17 of the General Conditions of Entitlement.

Ofcom is investigating this matter under the Communications Act 2003.
