Interested parties should note that on 22 July 2003 the Director received a formal complaint from another operator in respect of T-Mobile's alleged refusal to supply GSM Gateway Services. This operator requested that its identity remain confidential.
The Director's investigation into this complaint is ongoing, and he will publish his decision in respect of it by updating the Competition Bulletin.

Floe employs GSM Gateways to provide discounted mobile termination to UK companies. Floe alleges that Vodafone has periodically suspended Floe's gateway service on the grounds of unlawful activity, yet still permitted gateway services by others, including its own service providers.

On 18 July 2003 the Radiocommunications Agency issued an announcement which clarified the status of end-user equipment connecting to networks including GSM Gateways (http://www.radio.gov.uk/publication/press/2003/18july03.htm). Floe has stated that it has a valid contract in place with Vodafone which has the effect of making Floe's service legal.

Oftel is investigating this matter as a refusal to supply by Vodafone, in that it has been alleged that Vodafone is supplying certain operators who employ GSM Gateway Services while refusing to supply others. Investigation of this issue as a refusal to supply will assess Vodafone's stated grounds for refusing to supply Floe while allegedly supplying other operators that employ GSM Gateway Services.

Oftel is investigating this matter under the Competition Act.
