Note on the repeal of Regulation (EU) 2018/644 of the European Parliament and of the Council of 18 April 2018 on cross-border parcel delivery services

From 1 January 2021 Regulation (EU) 2018/644 of the European Parliament and of the Council of 18 April 2018 on cross-border parcel delivery services (“the Regulation”) does not apply in the United Kingdom.

This means that from this date, operators no longer have to provide Ofcom with data under Article 4 or Article 5 of the Regulation relating to company details, volumes, revenues, headcount and contractors (Article 4) and pricing (Article 5).

As a result, from 1 January 2021:

  • We are no longer providing or managing access to the PARCEL pricing reporting tool for operators in the UK
  • We are no longer distributing templates for the submission or update of Article 4(1) data
  • We will no longer provide online forms for the submission of Article 4(3) data in the Market Intelligence Database (MID) system (though previous forms from 2019 and 2020 may still be viewable in MID).

Please note that operators may still be subject to the Regulation in other jurisdictions in which they operate or have a presence. If in doubt, operators may wish to seek legal advice or contact the relevant national regulatory authorities (NRAs) for those geographies; Ofcom is unable to give guidance on these matters.

Operators in the UK continue to be under a legal obligation to provide Ofcom with specified data when required under Section 55 of the Postal Services Act 2011 and our programmatic collection of data from industry stakeholders will continue as in previous years.
