Investigation into Zayo Group UK Limited

Today we have opened an investigation into Zayo Group UK Limited (“Zayo”). The investigation concerns Zayo’s compliance with requirements imposed under an information request notice (the “Notice”) issued under section 135 of the Communications Act 2003 (the ‘Act’).

On 23 June 2025, Zayo was issued with a statutory notice under section 135 of the Act requiring the provision of information to assist Ofcom in assessing compliance with the security duties under sections 105A – 105D of the Act and the Electronic Communications (Security Measures) Regulations 2022. The Notice required Zayo to provide information regarding the measures it is taking to comply with its security duties.

Ofcom’s statutory information requests play a key part in Ofcom’s work and the information gathered from these requests informs how we carry out our statutory functions as a regulator. Therefore, it is essential that stakeholders provide accurate and complete information in a timely fashion. Where Ofcom has reasonable grounds for believing that a contravention of a requirement imposed under section 135 of the Act has occurred or is occurring, Ofcom may take enforcement action under section 138 of the Act.

The available evidence suggests that Zayo may not have complied with certain requirements imposed under section 135, in that information provided by Zayo in response to the Notice may not have been given to Ofcom within the timeframe specified by the Notice and the information may not have been complete and/or accurate.

Ofcom’s investigation will examine whether Zayo has failed to comply with its statutory duties in relation to Ofcom’s information requests.
