Notifications under sections 106(3) and 107(6) of the Communications Act 2003

This page contains links to copies of the consultation documents and final directions issued by Ofcom, pursuant to sections 106(3) and 107(6) of the Communications Act 2003 (the “Act”) respectively, in relation to the application of the electronic communications code (the “Code”) in a person’s case, and the revocation of Code powers.

Please note that this page does not set out copies of any documents relating to the grant of Code powers to persons prior to 25 July 2003. Prior to the entry into force of the Act on 25 July 2003, the Telecommunications Act 1984 (the “1984 Act”) set out the rules governing the application of Code powers. It enabled the Secretary of State to apply the Code to a particular person by a licence granted under section 7 of the 1984 Act. As a result of the implementation of the Act on 25 July 2003, the licensing regime established under the 1984 Act was abolished (subject to certain transitional provisions). For those persons that were granted Code powers by the Secretary of State before 25 July 2003, paragraph 17(2) of Schedule 18 (Transitional Provisions) of the Act provides that those persons shall be treated as a person in whose case the Code applies by virtue of a direction given by Ofcom. There are therefore a number of persons to whom the Code applies but for which there is no corresponding documentation below.
